The Supreme Court ruled that female relatives cannot be evicted from a shared household under the Protection of Women from Domestic Violence Act, 2005, simply because the husband fails to appear. The bench clarified that Section 19(1)(b) allows removal orders but explicitly prohibits such orders against women. The court overturned a magistrate’s order removing the complainant’s mother-in-law and sisters-in-law, stating they cannot be ousted for the husband’s non-appearance.
