BusinessSupreme Court Rules Foreign Software Payments Are Not Royalties
The Supreme Court rejected review petitions from the income tax department challenging its March 2021 decision that payments to non-resident foreign software companies for software purchases do not qualify as royalties and thus cannot be taxed as such. The tax department had argued these payments were royalties due to licensing involved in sales to end users.
