The Supreme Court ruled that the 24-hour deadline to produce an arrested person before a magistrate starts from the moment of detention, not from the formal arrest recording. Justices Ujjal Bhuyan and Atul S Chandurkar said excluding detention time violates Article 22(2) of the Constitution. The ruling arose from appeals by four accused under the NDPS Act, detained on September 29, 2025, but formally arrested the next day. The court ordered their immediate release due to 18 hours of custody without judicial oversight.
