The Supreme Court ruled that private citizens can file criminal complaints against election candidates for submitting false affidavits without needing prior sanction from the Election Commission or any public servant. The court clarified that offences under Section 125-A of the Representation of the People Act, 1951, are not restricted by Section 195 of the CrPC, allowing courts to take cognizance of such complaints filed by private individuals.
