Supreme Court Allows Divorce by Mutual Consent Without Waiting Period

The Supreme Court ruled that under Article 142, it can grant divorce by mutual consent even if the statutory waiting period under Section 13-B of the Hindu Marriage Act is not completed. The bench of Justices B V Nagarathna and R Mahadevan emphasized that once spouses settle all disputes and the marriage is irretrievably broken, the court may directly pass a divorce decree to avoid prolonged litigation. This decision came despite 18 pending civil and criminal cases between the parties.
