The Patna High Court ruled that lying on a woman and covering her mouth without any act of penetration does not constitute attempted rape if evidence shows the accused did not move beyond preparation. The case involved a man who entered a widow's home in February 2010, covered her mouth, and was caught by villagers. He was sentenced to four years under Sections 376/511 IPC and six months under Section 448 IPC, to run concurrently.
