The Karnataka High Court ruled that criminal prosecution cannot be used to recover financial liabilities unless the basic elements of a criminal offence are prima facie established. Justice Suraj Govindaraj quashed proceedings initiated by State Bank of India against petitioner Pritesh Bari, who took a loan for an apartment under a tripartite agreement with a builder. The complaint alleged the builder sold the property without bank consent while the Rs 39.92 lakh loan remained unpaid, accusing breach of trust and misappropriation.
