The Bombay High Court ruled on November 3 that Section 75 of the Bharatiya Nyay Sanhita applies when the complainant is a transgender person identifying as a woman. Justice Mehroz Pathan rejected the argument against applying Section 75, noting the complainant has undergone hormone therapy and identifies as a woman. The FIR alleges the applicant, Vishal Ingle, outraged the modesty of the complainant. Ingle, a former Agniveer, faces charges under Sections 75 and 296 of the BNS and the Transgender Persons (Protection of Rights) Act, 2019.
